F.D.A. and States Meet About Regulation of Drug Compounders

SILVER SPRING, Md. – The Food and Drug Administration conferred with public health officials from 50 states on Wednesday about how best to strengthen rules governing compounding pharmacies in the wake of a national meningitis outbreak caused by a tainted pain medication produced by a Massachusetts pharmacy.




It was the first public discussion of what should be done about the practice of compounding, or tailor-making medicine for individual patients, since the F.D.A. commissioner, Dr. Margaret Hamburg, last month testified in Congress about the need for greater federal oversight of large compounding pharmacies. So far, 620 people in 19 states have been sickened in the outbreak, and 39 of them have died.


Pharmacies fall primarily under state law, and the F.D.A. convened the meeting to get specifics from states on gaps in the regulatory net and how they see the federal role. Large-scale compounding has expanded dramatically since the early 1990s, driven by changes in the health care system, including the rise of hospital outsourcing.


“It is very clear that the health care system has evolved and the role of the compounding pharmacies has really shifted,” Dr. Hamburg said in a telephone interview on Tuesday. She said the laws have not kept pace. “We need legislation that reflects the current environment and the known gaps in our state and federal oversight systems.”


Under current law, compounders are not required to give the F.D.A. access to their books, and about half of all the court orders the agency obtained over the past decade were for pharmacy compounders, though compounders are only a small part of the agency’s regulatory responsibilities.


The F.D.A.'s critics argue that the agency already has all the legal authority it needs to police compounders. They say many compounders have been operating as major manufacturers, shipping to states across the country, and that the F.D.A. should be using its jurisdiction over manufacturers to regulate those companies’ activities.


“There should be one uniform federal standard that is enforced by one agency – the F.D.A.,” said Michael Carome, deputy director of Public Citizen’s Health Research Group, a nonprofit consumer organization, who has been a critic of the agency’s approach. “They have been lax in enforcing that standard.”


But Dr. Hamburg contends that the distinction is not so simple. Lumping large compounders in with manufacturers would mean they would have to file new drug applications for every product they make, a costly and time-consuming process that is not always necessary for the products they make, which may include IV feeding tube bags. Dr. Hamburg has proposed creating a new federal oversight category for large-scale compounders, separate from manufacturers.


“What concerns me is the idea that we could assert full authority over some of these facilities as though they were manufacturers, as though there were an on-off, black-white option,” Dr. Hamburg said. “That is a heavy-handed way to regulate a set of activities that can make a huge positive difference in providing necessary health care to people.”


Large-scale compounders play an important role in the health care supply chain when they produce quality products, F.D.A. officials say. They fill gaps during shortages and supply hospitals with products that can be made more safely and cost-effectively in bulk than in individual hospitals. Officials said they wanted to make sure the products made by such suppliers were safe, but were also concerned about disrupting that supply.


Carmen Catizone, head of the National Association of Boards of Pharmacy, said states are not equipped to regulate the large-scale compounders and that the F.D.A. needs to find a middle path for regulating them.


“Either hospitals are not going to like the solution, or the manufacturers aren’t going to like the fact that these guys get a shorter path,” he said. “But something’s got to give.”

President Barack Obama will be responsible for taxes rising on Americans if he does not "get serious" about a balanced deficit reduction plan or demand Senate passage of a Republican bill to prevent tax increases on all income below $1 million, House Speaker John Boehner charged on Wednesday.

"Tomorrow the House will pass legislation to make permanent tax relief for nearly every American," Boehner said in a short on-camera statement.


"Then the president will have a decision to make. He can call on the Senate Democrats to pass that bill, or he can be responsible for the largest tax increase in American history."

NIU frat members charged in hazing begin surrendering









Twenty-two members of a suspended Northern Illinois University fraternity began turning themselves in at police stations throughout the area today, the day after they were charged with hazing for allegedly supplying the alcohol that killed a student.


DeKalb County authorities late Monday issued warrants for the members of the Pi Kappa Alpha chapter charged in the death of David Bogenberger of Palatine.


The 19-year-old freshman's body was found in the fraternity house Nov. 2, the night after an alcohol-themed party,  where officials said he downed a lethal amount of liquor.





Because the warrants issued are valid throughout Illinois and adjoining states, and because NIU is on semester break, the fraternity members have the option of turning themselves at their hometown police stations, DeKalb police said today.


The chapter president, Alexander M. Jandick, 21, surrendered at the Naperville police station, posted $1,500 cash bond and was released, according to the DeKalb circuit clerk's office.


Jandick, a Naperville resident, is expected to have his initial court date set within the next several days.


He and four other fraternity officers were charged with felony counts of hazing.


According to the complaint, they "knowingly required David Bogenberger … to drink alcohol, an act not sanctioned by NIU, for purposes of induction into the NIU chapter of Pi Kappa Alpha."


The other 17 students are charged with misdemeanor counts of hazing. DeKalb County State's Atty. Richard Schmack declined to comment Tuesday on whether his office is considering additional charges.


Police say Bogenberger drank the lethal amount of alcohol in a two-hour period during a pledge initiation where he went from door to door inside the fraternity, answering questions in exchange for drinks of vodka and other liquor.


Authorities say the fraternity kept the party a secret so they could serve liquor without oversight, evading the university inspection that would accompany a sanctioned gathering.


In addition to the criminal charges, NIU fraternity and sorority members also are facing academic sanctions by NIU.


NIU officials said Tuesday that 31 men and women face disciplinary charges in connection with the hazing, and that more students may be charged. The university previously had said that 31 fraternity members faced charges, but amended that Tuesday to say the number includes both fraternity and sorority members.


The students are accused of violating the portion of the university's code of conduct that addresses hazing and alcohol. Penalties range from a reprimand to suspension or expulsion from the school.


"I believe there will be more charges coming," said Jeanne Meyer, NIU's director of community standards and student conduct. "We will pursue whatever information we receive."


Meyer said it's likely that some of the students will face additional charges, and that additional students will be charged.


The disciplinary charges against the students were issued Dec. 7, and the students are entitled to one-on-one hearings. The hearings are scheduled to begin when students return to school in January, Meyer said.


The Pi Kappa Alpha fraternity also has been suspended pending disciplinary procedures that could lead to its permanent removal from campus.


University officials said the Pi Kappa Alpha fraternity violated university procedures when it failed to register the Nov. 1 "parents night" party in which senior members of the fraternity and associated sororities were assigned as mentors to new members. Bogenberger and the 18 other pledges went from room to room in the Pi Kappa Alpha fraternity, answering questions in exchange for vodka and other liquor.


NIU policy requires that all Greek social events be registered and approved in advance. For fraternity or sororities to host events that include alcohol, a minimum of 51 percent of the members must participate in a mandatory training program with NIU officials that includes information on responsible drinking, at-risk behaviors and how to help a friend.

New Android botnet discovered across all major networks






A new Android spam botnet has been discovered across all major networks that sends thousands of text messages without a user’s permission, TheNextWeb reported. The threat, which is known at SpamSoldier, was detected on December 3rd by Lookout Security in cooperation with an unnamed carrier partner. The malware is said to spread through a collection of infected phones that send text messages, which usually advertise free versions of popular paid games like Grand Theft Auto and Angry Birds Space, to hundreds of users each day.

Once a user clicks on the link to download the game, his or her phone instead downloads the malicious app. When the app is downloaded, SpamSoilder removes its icon from the app drawer, installs a free version of the game in question and immediately starts sending spam messages.

The security firm notes that the threat isn’t widespread, however it has been spotted on all major carriers in the U.S. and has potential to do serious damage if something isn’t done soon to stop it.

CBS dominates week in TV ratings






NEW YORK (AP) — CBS had little competition for dominance last week in the television ratings.


The network had 17 of the 25 most-watched programs on the air last week, according to the Nielsen company. It beat second-place NBC by an average of nearly four million viewers a night last week, and also took the 18-to-49-year-old demographic that advertisers seek.






“60 Minutes” and “NCIS” were the most popular shows on CBS last week. As is typical in the fall, NBC‘s Sunday night football matchup was the week’s most-watched show.


One end-of-year tradition, Barbara Walters‘ survey of the year’s most popular personalities, finished No. 27 in the week’s ratings with 7.6 million viewers.


On cable, Showtime’s “Dexter” and “Homeland” both hit series records for their season finale episodes on Sunday. “Dexter” had 2.8 million viewers and “Homeland” had 2.3 million. Showtime preceded each episode with a disclaimer, warning that audiences might find the shows too intense so soon after the Connecticut school killings.


CBS averaged 11.9 million viewers for the week in prime time (7.3 rating, 12 share). NBC had 7.3 million (4.5, 7), ABC had 5.1 million (3.3, 5), Fox had 4.4 million (2.7, 4), the CW had 1.7 million (1.1, 2) and ION Television had 1.3 million (0.9, 1).


Among the Spanish language networks, Univision led with an average of 3.2 million viewers (1.7, 3). Telemundo had 1.3 million (0.7, 1), TeleFutura had 850,000 (0.4, 1), Estrella had 340,000 (0.2, 0) and Azteca had 140,000 (0.1, 0).


NBC‘s “Nightly News” topped the evening newscasts with an average of 9.4 million viewers (6.3, 12). ABC’s “World News” was second with 8.3 million (5.5, 11) and the “CBS Evening News” had 7.2 million viewers (4.9, 9).


A ratings point represents 1,147,000 households, or 1 percent of the nation’s estimated 114.7 million TV homes. The share is the percentage of in-use televisions tuned to a given show.


For the week of Dec. 10-16, the top 10 shows, their networks and viewerships: NFL Football: San Francisco at New England, NBC, 23.23 million; “60 Minutes,” CBS, 19.63 million; “NCIS,” CBS, 17.65 million; “The Big Bang Theory,” CBS, 16.74 million; “NCIS: Los Angeles,” CBS, 15.12 million; “Sunday Night NFL Pre-Kick,” NBC, 14.62 million; “Person of Interest,” CBS, 14.08 million; “Two and a Half Men,” CBS, 13.34 million; “The Voice” (Monday), NBC, 12.33 million; “Criminal Minds,” CBS, 12.01 million.

McDonald's urging franchisees to open on Christmas









McDonald's Corp. is urging U.S. restaurant owners to take the unusual step of opening on Christmas Day to deliver the world's biggest hamburger chain with the gift of higher December sales, AdvertisingAge reported Monday.

The request -- which comes as McDonald's tangles with resurgent rivals such as Wendy's, Burger King and Yum Brands' Taco Bell chain -- would be a break from company tradition of closing on major holidays.

"Starting with Thanksgiving, ensure your restaurants are open throughout the holidays," Jim Johannesen, chief operations officer for McDonald's USA, wrote in a Nov. 8 memo to franchisees -- one of two obtained by AdvertisingAge.

"Our largest holiday opportunity as a system is Christmas Day. Last year, (company-operated) restaurants that opened on Christmas averaged $5,500 in sales," Johannesen said.

"The decision to open our restaurants on Christmas is in the hands of our owner/operators," McDonald's spokeswoman Heather Oldani told Reuters.

Don Thompson took over as chief executive at McDonald's in July and has the difficult task of growing sales from last year's strong results in a significantly more competitive environment.

McDonald's monthly global sales at established restaurants fell for the first time in nine years in October, but unexpectedly rebounded in November.

The November surprise was partly due to a 2.5 percent rise in sales at U.S. restaurants open at least 13 months.

"Our November results were driven, in part, by our Thanksgiving Day performance," Johannesen wrote in a Dec. 12 memo to franchisees.

Oldani said 1,200 more McDonald's restaurants were open on Thanksgiving this year versus last year -- not 6,000 more as AdvertisingAge reported.

Still, the company has a high hurdle when it comes to posting an increase in restaurant sales this month because its U.S. same-restaurant sales jumped 9.8 percent in December 2011.

"It's an act of desperation. The franchisees are not happy," said Richard Adams, a former McDonald's franchisee who now advises the chain's owner/operators.

The push to open on the holidays goes against McDonald's cultural history, said Adams. In his first published operations manual, McDonald's Corp. founder Ray Kroc said the company would close on Thanksgiving and Christmas to give employees time with their families, Adams said.

"We opened for breakfast on Thanksgiving the last couple years I was a franchisee. It was easy to get kids to work on Thanksgiving because they want to get away from their family, but not on Christmas," Adams said.

University of Chicago's Indiana Jones mystery solved









A mystery at the University of Chicago unfolded like the dotted lines on an old map in classic Indiana Jones movies.


Last week, the university posted photos of a package it had received, addressed to none other than Henry Walton Jones, Jr., better known to most as Indiana Jones. Inside was a replica of the fictional U. of C. professor Abner Ravenwood's journal from the "Raiders of the Lost Ark" film. With no explanation, the university reached out via Tumblr, asking visitors to the blog help solve the mystery. Was it a hoax? A clever admissions stunt? A misaddressed Christmas gift? Senior Admissions Adviser Grace Chapin found out the answer Monday morning, and it was none of the above.


The journal and packaging originated from Guam, where an Ebay seller who specializes in replica Indiana Jones props sent it off to the highest bidder who lives in Italy. On its way, the smaller package, addressed to Indy at U. of C., fell out of a larger package. Not realizing what had happened, USPS apparently inserted the correct zip code and shipped it to Chicago.





“What we can piece together, USPS honored the postage, which happens to be fake,” she told RedEye, adding that the Ebay seller confirmed Monday he had received a letter from USPS explaining what happened.


But before the mystery was solved, the university received tons of suggestions and conspiracy theories as to the origin of the package (see photos of it here). It even made international news, with outlets from Norway to Spain to Germany asking for permission to use the photos.


“We’ve been so amused that other people have thought this was so funny,” she said. “This is how fun the world is at this point, something being sent from Guam to Italy and it finds its way to us.”


Chapin said the Ebay seller has told the university it can keep the journal, and that currently several groups on campus are offering to put it on display or archive it, though no solid plans have been made.

Channing Tatum, Jenna Dewan-Tatum expecting baby






NEW YORK (AP) — The Sexiest Man Alive will soon be a sexy dad.


Actor Channing Tatum and his wife Jenna Dewan-Tatum are expecting their first child in 2013, their reps confirm.






The news was first reported by People.com, which named Tatum the Sexiest Man Alive in November.


The couple, who recently co-starred in the film “10 Years,” met on the 2006 dance film “Step Up,” and wed in 2009.


Besides a baby, the new year will be a busy year for the parents-to-be. Tatum has at least four movies in the works while Dewan-Tatum appears on this season of “American Horror Story: Asylum” and has a TV movie called “She Made Them Do It” premiering Dec. 29 on Lifetime.

Aid: African Children Still at Risk of Pneumonia Despite Ceramic Stoves





Small ceramic indoor stoves, such as those sold by women in AIDS self-help groups in Africa, do save fuel and cut down on eye-irritating smoke, a new study has found — but they do not save children from pneumonia.


The study, published in The American Journal of Tropical Medicine and Hygiene, compared 168 households in rural Kenya that used either “upesi jiko” stoves or traditional three-stone indoor fires. The former — the name means “quick stove” in Swahili — has a locally made ceramic firebox that sells for $3. Clay and mud must be built up around it to insulate it and support the pot.


Since it uses less wood, it saves local forests. But it has no chimney, so the smoke stays indoors.


Biweekly visits by researchers found that children in both the stove and open-fire homes got pneumonia equally often. Pneumonia is a leading cause of death for infants in poor countries, and a 2008 study showed that the fine particles and toxic gases in cooking smoke inflame their lungs, doubling the pneumonia risk.


Two years ago, Secretary of State Hillary Rodham Clinton committed $50 million in American aid to help the Global Alliance for Clean Cookstoves get 100 million efficient stoves into households by 2020. But experts are still divided over which stove to pursue; chimneys do not solve all the problems, and stoves with fans burn more cleanly but are expensive and fragile.
